Welcome to Indie Tube (“Indie Tube,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Indie Tube website, applications, services, and content platform (collectively, the “Service”).

By accessing or using Indie Tube, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Account Registration

You must be at least 13 years old to use Indie Tube. By creating an account, you represent that:

  • You are legally permitted to use the Service

  • All information you provide is accurate and current

  • You are responsible for maintaining the security of your account

You are responsible for all activity that occurs under your account.

2. Platform Role & Disclaimer

Indie Tube is a content hosting and distribution platform.
We do not own, control, or pre-screen user-uploaded content.

Creators are solely responsible for the content they upload, including compliance with all applicable laws, licenses, and rights.

3. User Content & License Grant

By uploading content to Indie Tube, you retain ownership of your content.

However, you grant Indie Tube a non-exclusive, worldwide, royalty-free, sublicensable license to host, stream, display, distribute, and promote your content solely for the purpose of operating and marketing the platform.

This license terminates when your content is removed, except where continued storage is required for legal or operational purposes.

4. Content Standards & Prohibited Use

You agree not to upload, post, or distribute content that:

  • Infringes intellectual property rights

  • Is unlawful, defamatory, or deceptive

  • Contains sexual exploitation of minors (zero tolerance)

  • Constitutes hate speech or harassment

  • Promotes criminal activity or fraud

  • Contains malware or harmful code

Indie Tube reserves the right to remove content or terminate accounts at its sole discretion.

5. Monetization & Advertising

Monetization eligibility, ad placement, and revenue participation are subject to Indie Tube’s policies and advertiser requirements.

Indie Tube does not guarantee revenue, impressions, views, or earnings.

We reserve the right to:

  • Limit or disable monetization

  • Reject or remove advertisements

  • Modify monetization programs at any time

6. Payments & Fees

If you purchase subscriptions, advertising, or paid features:

  • Payments are processed through third-party providers

  • All fees are non-refundable unless otherwise stated

  • You are responsible for applicable taxes

7. Copyright & DMCA Policy

Indie Tube respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

7.1 Reporting Copyright Infringement

If you believe your copyrighted work has been infringed, submit a DMCA notice including:

  1. Your physical or electronic signature

  2. Identification of the copyrighted work

  3. Identification of the infringing material and its location

  4. Your contact information

  5. A good-faith statement that the use is unauthorized

  6. A statement under penalty of perjury that the notice is accurate

7.2 Counter-Notification

If your content was removed due to mistake or misidentification, you may submit a counter-notification including:

  • Your signature

  • Identification of removed content

  • A statement under penalty of perjury

  • Your contact information

  • Consent to federal court jurisdiction

Upon valid counter-notification, Indie Tube may restore the content unless legal action is filed.

7.3 Repeat Infringers

Indie Tube reserves the right to terminate accounts of repeat infringers.

8. Termination

Indie Tube may suspend or terminate your access to the Service at any time for violations of these Terms or applicable laws.

You may stop using the Service at any time.

9. Third-Party Services & Links

Indie Tube may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
Indie Tube makes no warranties regarding availability, accuracy, or uninterrupted service.

11. Limitation of Liability

To the maximum extent permitted by law, Indie Tube shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Indie Tube, its owners, officers, and affiliates from claims arising from:

  • Your content

  • Your use of the Service

  • Your violation of these Terms

13. Modifications

Indie Tube may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

 

16. Creator Upload Agreement

By uploading content to Indie Tube, you acknowledge and agree to the following:

16.1 Creator Responsibilities

You represent and warrant that:

  • You own all rights to the content you upload or have secured all necessary licenses, permissions, and releases

  • Your content does not infringe copyrights, trademarks, publicity rights, or privacy rights

  • Your content complies with all applicable laws and regulations

You are solely responsible for your content and any claims arising from it.

16.2 Content Hosting & Distribution

Indie Tube may:

  • Stream, host, encode, transcode, cache, and distribute your content

  • Display your content across Indie Tube–owned platforms, apps, and marketing channels

  • Promote your content to users and advertisers

Indie Tube is not obligated to distribute, promote, or continue hosting any content.

16.3 Content Removal

Indie Tube reserves the right to:

  • Remove or restrict content at any time

  • Disable access to content under legal, policy, or business requirements

  • Remove content in response to DMCA takedown notices

Content removal does not entitle creators to compensation or damages.

16.4 Creator Termination

If your account is terminated:

  • Indie Tube may remove or retain content as required by law

  • Any unpaid earnings below payout thresholds may be forfeited

17. Revenue Share & Monetization Terms

 

17.1 Monetization Eligibility

Monetization is not automatic.

Eligibility may depend on factors including:

  • Content compliance

  • Audience engagement

  • Advertiser suitability

  • Platform policies

Indie Tube may approve, deny, suspend, or revoke monetization at its discretion.

17.2 Revenue Share Structure

If a revenue share program is offered:

  • Creators may earn a percentage of net advertising or subscription revenue

  • “Net revenue” means gross revenue minus platform fees, payment processing costs, taxes, refunds, and operational expenses

Specific percentages, payout thresholds, and schedules may change and will be communicated through the platform or creator dashboard.

17.3 No Earnings Guarantee

Indie Tube does not guarantee:

  • Views

  • Ad fill rates

  • Revenue amounts

  • Minimum payouts

Earnings depend on demand, advertiser availability, audience behavior, and platform performance.

17.4 Payments & Taxes

Creators are responsible for:

  • Providing accurate payout information

  • Any taxes owed on earnings

Indie Tube may withhold payments where required by law or for compliance reviews.

18. Self-Serve Advertising Platform Terms

 

18.1 Advertiser Dashboard Access

Indie Tube may offer advertisers a self-serve dashboard to create, manage, and monitor advertising campaigns.

Access may be suspended or revoked for violations of:

  • Advertiser Terms

  • Platform policies

  • Applicable laws

18.2 Campaign Approval & Delivery

  • All ads are subject to review and approval

  • Approval does not guarantee continued placement

  • Indie Tube may pause or remove ads at any time

Indie Tube does not guarantee impressions, clicks, conversions, or return on investment.

18.3 Metrics & Reporting

Analytics provided are:

  • Estimates for informational purposes

  • Not guaranteed or error-free

Indie Tube is not responsible for discrepancies between internal metrics and third-party tracking tools.

18.4 Refunds

Advertising purchases are:

  • Prepaid

  • Non-refundable once a campaign has started

  • Subject to billing dispute review at Indie Tube’s discretion

18.5 Ad Placement & Brand Safety

Indie Tube may:

  • Control ad placement

  • Exclude ads from specific content categories

  • Limit ads to maintain brand safety and platform integrity

19. Platform Modifications & Availability

 

Indie Tube may:

  • Modify features, monetization models, or services

  • Temporarily suspend access for maintenance or upgrades

  • Discontinue features without liability
